IMPORTANT: This End User License Agreement ("EULA" or "Agreement") is a legal contract between you ("End-User" or "you") and CheckEt Team ("Developer," "we," "us," or "our") — not with Apple Inc. or Google LLC. By downloading, accessing, or using the CheckEt application (the "Licensed Application") from the Apple App Store or Google Play Store (each, the "Distribution Platform"), you agree to be bound by this Agreement.

1. Acknowledgement

This EULA is a legally binding agreement concluded solely between you and CheckEt Team.Neither Apple Inc. nor Google LLC is a party to this EULA, and neither bears any responsibility for the Licensed Application or its content. CheckEt Team is solely responsible for the Licensed Application, its content, and compliance with applicable law.

This EULA does not conflict with the Apple Media Services Terms and Conditions or the Google Play Developer Distribution Agreement. In the event of any conflict with platform terms, those platform terms shall prevail solely to the extent of that conflict.

2. Scope of License

Subject to your full compliance with this Agreement, CheckEt Team grants you a limited, personal, non-exclusive, non-transferable, revocable license to download, install, and use the Licensed Application on the device(s) on which you downloaded it, solely for your own personal, non-commercial purposes, and in accordance with the Usage Rules of the Distribution Platform through which you obtained the Licensed Application.

  • This license may be extended to other accounts associated with you via Family Sharing or volume purchasing (Apple App Store) or Family Library (Google Play), as permitted by the applicable platform's rules.
  • You may not sublicense, sell, resell, transfer, assign, or commercially exploit the Licensed Application or any portion thereof.
  • You may not reverse-engineer, decompile, disassemble, modify, or create derivative works of the Licensed Application.
  • You may not copy or reproduce the Licensed Application except as expressly permitted by applicable law or this Agreement.
  • If you sell or transfer your device to a third party, you must remove the Licensed Application from that device beforehand.

3. Description of Service and Educational Purpose

CheckEt is a digital accessibility and food literacy tool designed to assist users in digitizing product labels via Optical Character Recognition (OCR) and matching ingredient data with user-defined criteria. The Licensed Application does not score, rank, or provide a "health grade" for products on its own authority; it functions as a digital assistant that highlights information based strictly on User-Defined Preferences.

4. Medical Disclaimer & Safety Limitations

Please read carefully: CheckEt is not a medical device or diagnostic tool.

  • Informational Purposes Only: All data matches and ingredient definitions are provided for educational purposes only and do not constitute medical advice, diagnosis, or treatment.
  • No Guarantee of Accuracy: Due to potential manufacturing changes, OCR misreadings, or AI-generated inaccuracies, results are NOT 100% GUARANTEED.
  • User Obligation: Individuals with severe allergies or medical conditions MUST NOT RELY SOLELY on the Licensed Application. You must always verify the physical packaging. CheckEt Team expressly disclaims all liability for health outcomes resulting from reliance on App data.

5. Maintenance and Support

CheckEt Team is solely responsible for providing maintenance and support services with respect to the Licensed Application, as required under applicable law.Neither Apple Inc. nor Google LLC has any obligation to furnish any maintenance or support services with respect to the Licensed Application.

6. Warranty Disclaimer

The Licensed Application is provided "as is" and "as available," with all faults and without warranty of any kind.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CHECKET TEAM EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT, AND NON-INFRINGEMENT.

In the event of any failure of the Licensed Application to conform to any applicable warranty:

  • Apple App Store users may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple will have no other warranty obligation with respect to the Licensed Application.
  • Google Play users may be eligible for a refund under Google Play's refund policy.
  • Any other claims, losses, liabilities, or damages attributable to any failure of warranty shall be CheckEt Team's sole responsibility.

7. Product Claims

CheckEt Team, not Apple Inc. or Google LLC, is responsible for addressing any claims by you or any third party relating to the Licensed Application or your possession and use thereof, including but not limited to:

  • (i) Product liability claims;
  • (ii) Any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement;
  • (iii) Claims arising under consumer protection, privacy, or similar legislation, including in connection with the Licensed Application's use of data and AI-generated content.

8. Intellectual Property Rights

In the event of any third-party claim that the Licensed Application or your possession and use thereof infringes a third party's intellectual property rights, CheckEt Team, not Apple Inc. or Google LLC, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

All content, software, and intellectual property within the Licensed Application — including the CheckEt name, logo, AI-generated summaries, and matching algorithms — are the exclusive property of CheckEt Team.

9. Legal Compliance

By downloading or using the Licensed Application, you represent and warrant that:

  • (i) You are not located in a country that is subject to a U.S. Government embargo, or designated as a "terrorist supporting" country by the U.S. Government; and
  • (ii) You are not listed on any U.S. Government list of prohibited or restricted parties.

12. Platform-Specific Provisions

🍎 Apple App Store Users

If you downloaded the Licensed Application from the Apple App Store, the following additional terms apply:

  • Third-Party Beneficiary: You and CheckEt Team acknowledge and agree that Apple Inc., and Apple's subsidiaries, are third-party beneficiaries of this EULA. Upon your acceptance of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
  • License Scope: The license granted herein is limited to use on Apple-branded products that you own or control, as further defined by Apple's Usage Rules.
  • Warranty Refunds: For warranty failures, you may notify Apple, and Apple may refund the purchase price as described in §6 above.

🤖 Google Play Users

If you downloaded the Licensed Application from Google Play, the following additional terms apply:

  • Google Play Developer Policies: Your use of the Licensed Application is also subject to the Google Play Developer Content Policy and the Developer Distribution Agreement.
  • Data Safety: Information about data collected by the Licensed Application is disclosed in the Google Play Data Safety section of the app listing, consistent with our Privacy Policy.
  • Transparent Subscription Disclosure: In compliance with Google Play Subscriptions Policy, CheckEt Team clearly and explicitly discloses all subscription terms — including price, billing frequency, automatic renewal terms, and whether a subscription is required to use the app — before any purchase is confirmed. Users are not required to take additional action to review this information.
  • Sustained Recurring Value: CheckEt Premium subscriptions provide sustained and recurring value throughout the life of the subscription (access to all premium AI label-reading features). Subscriptions are not used to offer one-time benefits (e.g., single-use credits). Any promotional bonuses offered are complementary to, and do not replace, this recurring value.
  • No Deceptive Practices: CheckEt Team does not engage in deceptive or manipulative subscription purchase experiences. CheckEt Premium is not mischaracterised as a free offer. Pricing is displayed in full (not only as a monthly breakdown for multi-month plans). All subscription terms and pricing are localised to the user's country and language where required.
  • In-App Subscription Management (Android): In compliance with Google Play policy, the Licensed Application provides in-app access to subscription management. You can manage or cancel your subscription directly via the Google Play Subscription Center or through the app's account settings.
  • Subscription Modification Prohibition: CheckEt Team will not retroactively modify a subscription (e.g., reduce or eliminate recurring benefits) to effectively convert it into a one-time offering after you have purchased the subscription.

13. Artificial Intelligence (AI) Transparency

In accordance with the EU AI Act and international transparency standards, you acknowledge that:

  • AI-Generated Content: All digitized summaries and ingredient analyses are generated or assisted by artificial intelligence (Google Gemini API). AI outputs are not infallible.
  • Rapid Response Protocol: Reported data inaccuracies are reviewed within a target window of 6 hours of notification.
  • Right to Object: You have the right to object to AI-driven matching results and request manual clarification.
  • No 100% Accuracy Guarantee: AI outputs may contain errors. Final responsibility lies with the user to verify the physical product packaging.

14. Brand Protection and Fair Use

  • You agree not to use the Licensed Application's matching data to engage in trade libel or product disparagement against any brand or manufacturer.
  • Public sharing of matching results with the intent to harm a brand's commercial reputation is strictly prohibited.

15. Acceptable Use Policy

The following actions are strictly prohibited:

  • Using the Application to make baseless disparaging claims against a brand or to create unfair competition (Turkish Commercial Code Art. 55).
  • Uploading fake label images to deceive AI models.
  • Attempting reverse engineering or unauthorized system access.
  • Reselling or distributing the Licensed Application or any part thereof for commercial purposes.

16. Account Management and Special Category Data

  • Personal Preferences: Dietary choices and sensitivities in your profile may constitute "Special Category Personal Data" (Health Data) under GDPR. This data is processed solely to provide your personalized service and is not shared with third parties without your explicit consent.
  • Account Security: You are solely responsible for maintaining the confidentiality of your account credentials.
  • Account Termination: CheckEt Team reserves the right to suspend or terminate your account for breach of this Agreement.

17. Subscription Terms (Auto-Renewable Subscriptions)

📋 CheckEt Premium — Subscription Information

Available Plans

  • CheckEt Premium Monthly: Length: 1 month | Price: as displayed in the App at the time of purchase
  • CheckEt Premium Annual: Length: 12 months | Price: as displayed in the App at the time of purchase

Billing & Payment

  • Payment is charged to your Distribution Platform account (Apple ID or Google Play account) upon purchase confirmation.
  • Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period.

Managing & Cancelling Your Subscription

  • iOS (App Store): Go to Settings → [Your Name] → Subscriptions → select CheckEt → Cancel Subscription.
  • Android (Google Play): Go to Play Store → Profile icon → Payments & subscriptions → Subscriptions → select CheckEt → Cancel Subscription. You may also cancel directly via the Google Play Subscription Center.

Effect of Cancellation

  • iOS (App Store): Cancellation takes effect at the end of the current billing period. Access to Premium features continues until the period ends. No refunds for partial periods.
  • Android (Google Play): Per Google Play's general policy, cancellation takes effect at the end of the current billing period and you retain access to Premium features until then. Users in certain countries may be eligible to cancel immediately and receive a prorated refund in accordance with applicable local law. CheckEt Team may implement a more flexible refund policy at its discretion — contact [email protected] for refund requests.

Free Trials & Introductory Offers

  • If a free trial or introductory price period is offered, the duration of the offer and the price you will be charged after the offer period ends will be clearly displayed before you confirm the purchase.
  • You will be automatically enrolled in a paid subscription at the end of the free trial or introductory period unless you cancel beforehand.
  • Instructions for cancelling a free trial are provided in the App and via the platform subscription management pages above.
  • iOS: Any unused portion of a free trial is forfeited upon purchase of a subscription. Android: You must cancel at least 24 hours before the end of the trial to avoid being charged.
  • Access to App content without a trial or subscription (where available) is clearly indicated in the App.

Price Changes

  • CheckEt Team will provide advance notice of any subscription price increase. For iOS users, Apple will notify you and require your consent before the increased price takes effect. For Android users, Google Play will notify you of the price change; continued use of the subscription after the effective date constitutes acceptance of the new price. You may cancel at any time if you do not accept the new price.

Subscription Content Integrity

  • CheckEt Premium provides sustained and recurring value throughout the life of the subscription. CheckEt Team will not retroactively reduce or eliminate subscription benefits after purchase. If material changes to subscription content are necessary, subscribers will be notified in advance.

18. Limitation of Liability

To the maximum extent permitted by applicable law, CheckEt Team shall not be liable for any personal injury, or any incidental, special, indirect, or consequential damages whatsoever, including:

  • Inaccuracies in label information provided by product manufacturers;
  • Technical errors from third-party AI models (e.g., Google Gemini);
  • Damages related to the consumption of products based on App matching results;
  • Loss of data, business interruption, or any other commercial loss.

In no event shall CheckEt Team's total liability exceed the amount you paid for the Licensed Application in the twelve (12) months preceding the claim.

By using the Licensed Application, you consent to the data practices described therein.

20. Termination

This Agreement is effective until terminated by you or CheckEt Team. Your rights under this Agreement will terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the Licensed Application and delete all copies in your possession.

21. Governing Law

This Agreement shall be governed by the laws of the Republic of Turkey, without regard to conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts of Izmir, Turkey.

If you are a consumer residing in the European Union, you may also benefit from any mandatory provisions of the law of your country of residence.

22. Changes to This Agreement

We may update this Agreement at any time by updating the "Last Updated" date above. Your continued use of the Licensed Application constitutes acceptance of the revised Agreement.

23. Severability

If any provision of this Agreement is held unenforceable, it shall be modified to the minimum extent necessary, and the remaining provisions shall continue in full force.

24. Entire Agreement

This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and CheckEt Team regarding the Licensed Application.
